This book discusses the role of law in the adaptive management of socio-ecological systems. Recent years have seen increased discussion regarding the relationship between adaptation and law, as if after decades of unfocus, legal scholars are finally starting to understand the impact of a scientific paradigm called 'adaptive management' on the legal field. Although the complex relationship between law and adaptive management of socio-ecological systems is increasingly debated, an in-depth examination of the scientific and theoretical underpinnings of such efforts has not been presented. Using the illustrative example of the European Union's water governance and its efforts towards implementing adaptive management, this book emphasizes the importance of a legal understanding of how to generate scientific knowledge about the environment.While always important, understanding the science carefully is especially important when dealing with complex ecosystem management as 'normatives' are created gradually before legislation begins to examine the 'facts' of the matter. After examining the roots of adaptive management, this book argues that law needs to understand itself as an integral part of the process of socio-ecological management of complex systems and not simply an external referee who resolves disputes.
